1. General Information

Bayview Motel is located at 31 Dempster Street, Esperance WA 6450, Australia.

By accessing or using our website and services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website.

2. Bookings and Payments

• All bookings are subject to availability.

• A valid credit card may be required to secure your reservation.

• Full payment may be required upon check-in unless otherwise arranged.

• Prices are in Australian Dollars (AUD) and include GST unless otherwise stated.

3. Cancellation and Refund Policy

• Cancellations must be made at least 48 hours prior to your scheduled arrival to avoid charges.

• Cancellations made less than 48 hours before arrival may incur a cancellation fee equivalent to one night’s accommodation.

• No-shows will be charged the full amount of the booking.

• Refunds (if applicable) will be processed to the original method of payment.

• No refunds will be issued for early departure.

4. Check-In / Check-Out

• Check-in time: From 2:00 PM

• Check-out time: By 10:00 AM

• Early check-in or late check-out is subject to availability and may incur additional charges.

• Guests must present valid photo identification and a credit card upon check-in.

5. Guest Responsibilities

• Guests are responsible for any damage and/or breakages to motel property during their stay.

• Smoking is not permitted in rooms. A cleaning fee will apply for violations.

• No pets are allowed unless approved in advance.

• Guests are advised to lock rooms and vehicles when unattended.

6. Privacy Policy

Bayview Motel values your privacy. Personal information collected during booking or correspondence is used solely to provide accommodation and service.

• From time to time, Bayview Motel Esperance may mail or email marketing information about special offers, improvements, or award wins.

• If you do not wish to receive such information, you may request removal from our marketing database (by ticking the opt-out box on registration, or by contacting reception).

• Our full Privacy Policy is available on our website or at reception.

• We will not share your information with third parties unless required by law.

7. Liability

Bayview Motel accepts no responsibility for any loss, damage, or injury to persons or property during your stay. Guests are encouraged to secure their belongings and take appropriate precautions.

Traveller Accommodation Providers (Liability) Act 2001

The Traveller Accommodation Providers (Liability) Act 2001 changes the common law about Innkeeper’s liability.

Under this Act, Bayview Motel may be liable to make good any loss of a Guest’s property in certain circumstances even though the loss is not caused by the fault of the accommodation provider, or the provider’s agent.

The strict liability:

• Applies only to a Guest of the accommodation provider on a day when an accommodation unit is provided for the use of the Guest.

• Is limited to AUD $250 for each accommodation unit provided for the use of the Guest on the day, unless the Guest’s property was placed in secure safe custody facilities.

• Does not cover motor vehicles and things owned by the Guest left in or on motor vehicles.

Note: Words appearing in italics and bold have a special meaning under the Act.

8. Indemnity

• Guests staying at Bayview Motel Esperance take full responsibility for any damage and/or breakages incurred during their stay.

• Bayview Motel Esperance takes no responsibility for any lost or stolen items from accommodation or vehicles and suggests that Guests securely lock their accommodation and/or motor vehicle when unoccupied.

• No refunds will be issued under these circumstances.

• Upon departure, any key deposit or other bonds paid are refunded to Guests, provided the keys and/or hired items are returned in the same condition upon check-out.

• By signing the Guest Registration Card, you acknowledge and agree to these conditions and the Rules of Stay.

9. Newbook Payment Plan Terms & Conditions

Eligibility

• Guests must be 18 years of age or older.

• A valid credit or debit card is required to enrol in the payment plan.

Availability & Requirements

• Payment Plans are available only for bookings with a minimum total value of AUD $300.

• A minimum of 2 instalments must be selected to qualify.

• Payment Plans must be chosen at the time of booking and cannot be added later.

Instalment Frequency & Schedule

• The first payment will be deducted on the Payment Plan start date (typically the date of booking).

• Remaining instalments will be automatically deducted according to the chosen frequency:

  • Weekly: Every 7 days from the first payment.

  • Fortnightly: Every 14 days from the first payment.

  • Monthly: On the same date each month as the first payment.

• Final payment must be completed at least 7 days before check-in.

Payment Currency

• All payments are processed in Australian Dollars (AUD).

Missed or Failed Payments

• If an instalment is missed or declined, the guest will be notified via email.

• A late payment fee of AUD $15 may be charged.

• If payments remain outstanding beyond 7 days, the booking may be cancelled at our discretion.

• Any cancellation due to failed payments will be subject to our standard cancellation policy.

Cancellation Policy (Payment Plans)

• If the guest cancels the booking, any non-refundable payments already made will be retained.

• A cancellation fee of AUD $50 may apply.

• If eligible, refunds will be processed within 5–10 business days.

• Guests are encouraged to review the full Booking Cancellation Policy (see Section 3).

General Notes

• By selecting the Payment Plan option, the guest agrees to all terms outlined above.

• It is the guest’s responsibility to ensure sufficient funds are available on the nominated card for each scheduled instalment.

• Bayview Motel reserves the right to modify these terms at any time.

10. Website Use

• All website content is owned or licensed by Bayview Motel.

• You may not copy, distribute, or reproduce content without written permission.

• While we make every effort to ensure information is accurate, we do not guarantee its completeness or reliability.
